Terms of Service

These terms govern your use of shopmerrittcollective.com and any order you place with us. By using the site or buying from it, you agree to them. If you do not agree, please do not use the site.

In these terms, "Merritt Collective," "we," and "us" mean the business operating this store. "You" means the person using the site or placing an order.

Who we are

Merritt Collective is a curated shop. We work with independent makers who ship their pieces to you directly. When you buy from us, your contract is with Merritt Collective, and we are responsible to you for the order regardless of which maker fulfilled it.

Using the site

You may browse and buy for your own personal, non-commercial use. You may not scrape the site, resell our product data, interfere with the site's operation, attempt to gain access to accounts or systems that are not yours, or use the site for anything unlawful.

You must be at least 18, or have the consent of a parent or guardian, to place an order.

Products, descriptions, and images

We describe every piece as accurately as we can. Much of what we carry is handmade or made in small batches, so colour, grain, weave, and dimensions vary from piece to piece. Photographs are representative rather than exact, and screens render colour differently. Natural variation is not a defect — though if a piece arrives genuinely wrong, damaged, or not what you ordered, that is covered by our returns policy.

We may change or discontinue any product at any time.

Pricing and errors

All prices are in US dollars and exclude sales tax, which is calculated at checkout where applicable.

We try hard to keep pricing and availability accurate, but errors happen. If a piece is listed at the wrong price or is unavailable after you order, we will contact you and either confirm the corrected price before charging you, or cancel the order and refund you in full. We reserve the right to refuse or cancel any order, including after it has been confirmed.

Orders and acceptance

Placing an order is an offer to buy. Your order is accepted when we send a shipping confirmation, not when you receive an order confirmation email. We may limit or refuse quantities, and we may cancel orders that appear fraudulent or that we cannot fulfil.

Payment

Payment is taken at checkout through our payment processor. You confirm that you are authorised to use the payment method you provide. We do not store your full card details.

Shipping, returns, and cancellations

Our shipping policy and our returns and refunds policy form part of these terms. Please read them — they set out where we ship, what shipping costs, the return window, what we cover, and what cannot be returned.

Your account

If you create an account, keep your password confidential and let us know promptly if you think someone else has access to it. You are responsible for activity under your account.

Content you submit

If you send us reviews, photographs, or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and adapt it in connection with the shop. You confirm the content is yours to give and does not infringe anyone's rights. We may remove content at our discretion.

Our content

The site's text, photography, design, and branding belong to Merritt Collective or to the makers we work with, and are protected by copyright and trademark law. You may not copy or reuse them without permission.

Third-party links

The site may link to sites we do not control. We are not responsible for their content or their practices.

Disclaimers

The site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these terms, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the site will be uninterrupted or error-free.

Nothing in these terms limits your rights under any consumer protection law that applies to you and cannot be waived.

Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to any order is limited to the amount you paid for that order. We are not liable for indirect, incidental, special, or consequential damages, or for lost profits.

Indemnity

You agree to indemnify and hold us harmless from claims arising out of your misuse of the site or your breach of these terms.

Governing law and disputes

These terms are governed by the laws of the State of Arizona, without regard to its conflict of law rules. Any dispute arising out of or relating to these terms or an order will be brought in the state or federal courts located in Arizona, and you and we each consent to the jurisdiction of those courts.

Changes to these terms

We may update these terms from time to time. The version posted on this page at the moment you place an order is the version that applies to that order. Material changes take effect when posted.

Severability and entire agreement

If any provision of these terms is found unenforceable, the rest remain in force. These terms, together with our shipping, returns, and privacy policies, are the entire agreement between us regarding the site and your orders.
